In addition to injuries, workers may be exposed to substances resulting in disease or illness like mesothelioma, silicosis, asbestosis, and pneumoconiosis. These conditions are also covered under the Kentucky Workers' Compensation Act.

If an employer's or a co-worker's careless or reckless conduct resulted in the injury, disease, or illness, you cannot sue them for those actions except in limited circumstances. However, if a third-party who is not an employer or a co-worker caused the injury, disease or illness, the injured employee may bring a claim against that third-party in addition to, and for items of damages not covered and provided for through the workers' compensation claim.
